Welcome to WalkRace. These Terms of Service ("Terms") govern your access to and use of the WalkRace mobile application and its associated website. By using the application, you agree to be fully bound by these Terms. If you do not agree to these conditions, please do not download, install, or use the application.
⚠️ IMPORTANT MEDICAL DISCLAIMER: WalkRace is purely a recreational and social step-tracking game. It does not provide medical advice. You represent that you are in good physical health to exercise, and you fully release the developer from any liability regarding injuries or medical conditions.
1. Health Requirements & Medical Disclaimer
- No Medical Advice: The content, tracking metrics, leaderboards, and challenges provided by WalkRace are intended strictly for entertainment, gamification, and motivational purposes. They do not constitute professional medical advice, diagnosis, or treatment.
- Consult a Doctor: Before starting any physical activity, intense walking program, running, or steps competition via this application, you are highly encouraged to consult a qualified physician—especially if you have any pre-existing health conditions, joint issues, or cardiovascular concerns.
- Assumption of Risk: You acknowledge and agree that physical exercise involves inherent risks of injury. Using WalkRace and participating in step duels or group races is at your own sole risk and peril. The developer of WalkRace shall not be held liable in any way for physical injuries, joint damage, cardiac events, health deterioration, or death resulting directly or indirectly from using the app.
2. "As Is" Service & Data Synchronization
The application is provided on an "as is" and "as available" basis. Step synchronization depends entirely on the physical sensors of the user's device, system APIs (Apple HealthKit), and internet connectivity. The developer makes no warranties, express or implied, regarding:
- The immediate or real-time accuracy of step counts, calculated distances, or active metrics, which rely on third-party hardware sensors and operating system layers.
- The absolute continuity, uptime, stability, or total absence of database errors, glitches, server crashes, or temporary outages (managed via market-leading cloud providers like Supabase).
- The uninterrupted preservation or accidental loss/corruption of steps records, historical streaks, duel outcomes, or user profile settings due to network disconnects or technical updates.
3. Limitation of Liability & Ranks/Streaks
To the maximum extent permitted by applicable law, the developer of WalkRace shall in no event be liable for any direct, indirect, incidental, special, punitive, or consequential damages (including, but not limited to, financial loss, bodily harm, physical injury, hardware damage, or data loss) arising out of your use or inability to use the application.
Loss of Streaks and Standing Positions: Under no circumstances shall the developer be held liable for the loss of daily step streaks, rank drops on standings, delayed badge unlocks, or lost duels caused by network sync lag, HealthKit data transmission delays, or scheduled server maintenance. The game runs in real-time, and data successfully synced and saved to our database is the only source of truth for rankings.
In all cases, the developer's maximum total liability to you for any claim or damage arising from using the application shall be strictly capped at 0.00 EUR (zero euros) or the actual amount paid by you for premium subscription functions (PRO) within the twelve months preceding the event.
4. Community Guidelines, Anti-Cheating & Banning Policy
WalkRace thrives on honest, healthy competition, transparency, and mutual respect. You strictly agree not to alter or spoof the genuine spirit of the game. Specifically, it is forbidden to:
- Step Spoofing (Cheating): Generate, simulate, or send fake, artificially accelerated, or manipulated step data to the app's servers (including the use of physical step-shaker rigs, software emulators, automated scripts, or manual injection of fictitious data into Apple HealthKit logs).
- Social Abuse: Use offensive, discriminatory, threatening, or harassing language in comments, group chats, or user nicknames.
- Inappropriate Content: Upload profile photos or avatars that are copyrighted, vulgar, obscene, or otherwise inappropriate.
Banning & Penalty Consequences: The developer enforces a strict zero-tolerance policy against cheating. We reserve the absolute, indisputable right to reset daily steps, remove you from public leaderboards, wipe stats, or **permanently ban the account** of any user violating these guidelines, at any time and without prior notice.
⚠️ NO-REFUND CLAUSE: In the event of an account ban or permanent suspension due to cheating, fraud, or violations of Fair Play, **the user immediately forfeits all access to Premium (PRO) features and shall not be entitled to any refund, compensation, or reimbursement** for any fees or purchases previously paid.
5. PRO Features, In-App Purchases (StoreKit) & Refund Policy
The application offers the ability to unlock exclusive, premium features via in-app purchases or subscriptions to WalkRace PRO.
- Billing and Processing via Apple: All in-app purchases, subscription payments, renewals, and financial transactions are processed, billed, and managed entirely by Apple Inc. through the official **Apple App Store (StoreKit)**. The developer of WalkRace does not store or have access to users' billing addresses or credit card numbers.
- Subscription Management & Refunds: Any request for a refund, billing dispute, cancellation, or management of automatic subscription renewals must be initiated and handled directly by the user through their official Apple ID account settings, subject to the Apple App Store Terms and Conditions. The developer does not have the technical capability or legal authority to issue refunds on behalf of Apple.
- Price Adjustments: We reserve the right to modify pricing or premium features associated with WalkRace PRO at any time. Any price changes for active subscriptions will be communicated in advance by Apple in compliance with App Store guidelines.
6. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Italy. Any dispute arising out of the interpretation or execution of these conditions shall be submitted to the exclusive jurisdiction of the court of residence of the developer.
